WASHINGTON, Circuit Judge.

In this case the United States District Court for the District of Columbia issued a judgment, pursuant to 8 U.S.C.A. § 903, declaring that the plaintiff-appellee, Irving Albert, is a citizen of the United States. The decree also enjoined the defendant Dean G. Acheson, Secretary of State, from denying Albert a passport "on the ground or for the reason that he is not a citizen of the United States of America."1
