This action arises out of the filing of a petition for a writ of habeas corpus by appellant in the LaPorte Circuit Court seeking release from the Indiana Hospital for Insane Criminals at Michigan City.

On July 8, 1939, appellant was charged by affidavit in the Wabash Circuit Court with commission of a felony, namely: "Committing Bodily Injury upon a Police Officer." He was, on said date, apprehended and confined in the Wabash County Jail...
