HAWKINS, Justice.

An indictment in two counts, the first charging robbery by force and intimidation, and the second charging robbery by "suddenly snatching," was returned against Hugh Osborne. The trial judge charged the jury that "the facts in the case do not apply to the second count, which is sudden snatching; so I ask you to confine yourself to the first count." The jury returned a verdict of guilty on the first count...
