Appellant was indicted for perjury under Acts of 1927, Ch. 203, § 8, p. 580, § 10-3802, Burns' 1942 Replacement, tried by jury, found guilty as charged and sentenced to imprisonment in the Indiana State Prison for a term of not less than one [1] nor more than ten [10] years.

Seven errors are assigned, but of these we deem it necessary to consider only three. (1) The trial court erred in overruling...
