HOLT, Justice.

A jury found appellant guilty of the crime of involuntary manslaughter and fixed his punishment at a term of three years in the penitentiary and a fine of $1,000. From the judgment is this appeal.

The information was based upon the following sections of the statute, Ark.Stats. 1947, Section 41-2207: "Manslaughter defined.—Manslaughter is the unlawful killing of a human being, without malice...
