Appellant, Edgar Singley, alias Pete Sing ley, was tried in the circuit court of Choctaw County under an indictment charging that he unlawfully and with malice aforethought killed Jesse Morgan, alias Sug Morgan, by striking him with a piece of "scantling" or a stick. The jury returned a verdict of murder in the first degree and fixed defendant's punishment at life imprisonment in the penitentiary. Judgment...
