This is an action in tort brought initially against the J.L. Shiely Company to recover damages for personal injuries. On motion of the J.L. Shiely Company, the trial court ordered that the Steenberg Construction Company be made a party defendant. This action came on for trial before a jury, which returned a verdict against both defendants and assessed plaintiff's damages at the sum of $40,000.
