MOORE, Justice.

The executors of the estate of John Novak, deceased, brought an action against plaintiff in error in the district court of the City and County of Denver to recover certain moneys belonging to said estate which had been converted by plaintiff in error to his own use. Findings and judgment of the Denver district court were in favor of the executors and this judgment was affirmed in Urbancich v. Jersin, 123 Colo. 88
