ADAMS, Justice.

This is an action of tort to recover damages to person and property by reason of a collision between an automobile owned and operated by the plaintiff and one operated by the defendant. The accident occurred on Columbian Avenue in the City of Rutland on January 27th, 1950. Trial was by jury. At the close of the plaintiff's evidence, the defendant moved for a directed verdict. The motion was granted and the case is here on the plaintiff's exception...
