On July 21, 1949, Oliver Esnault, Jr., a colored man, was shot and killed by the defendant, Oscar J. Richard, and his wife filed this suit for damages alleging that the defendant wrongfully, unlawfully, wilfully and wantonly killed her said husband; that the said killing was without provocation or justification, and that petitioner's said husband was in no way at fault.
