On September 2, 1950, Mahala Carlson, appellee, brought suit against Ray Griswold, appellant, in a district court of Tarrant County, Texas. For cause of action she alleged that in December, 1949, she advanced $5,000 to the appellant for the purpose of financing the purchase of used automobiles.
