Yardley, deceased, was the defendant in Count One, and Edwin Heinzeroth was the defendant in the second count. At the conclusion of the evidence offered on behalf of the plaintiff, the suit was dismissed as to the defendant, Edwin Heinzeroth, and Count Two was withdrawn...
