The defendant, Howard Fuller, was indicted by the Grand Jury of Jackson Parish, for the crime of manslaughter, the indictment charging that he had, on August 7, 1950, unlawfully killed Wesley Fuller. The deceased and the accused were brothers. Defendant was tried and convicted in the lower court and was there sentenced to serve eight years at hard labor in the State Penitentiary.
