Appellant was prosecuted by affidavit charging automobile banditry under the Acts of 1929, ch. 54, § 3, being § 10-4710, Burns' Revised Statutes, 1942 Replacement. To this affidavit appellant entered a plea of not guilty. He was tried before a jury which rendered a verdict of guilty and that he be imprisoned in the state prison for a period of ten years.
