We have considered this case on two other occasions. On the original hearing, we sustained a plea of prescription and ordered the defendant discharged. On rehearing, we set aside the decree and remanded the case to the district court for the purpose of determining the cause of the delay in the ruling on the bill of particulars and to ascertain whose fault it was that it had not been acted on before.
