This suit was instituted under the Jones Act, 46 U.S.C.A. § 688, by Florence G. Holliday, as the administratrix of the estate of Clinton O. Holliday, to recover damages for his death.

The libel alleges that the respondent owned, operated and controlled the S. S. Peter Kerr; that in February, 1942, Holliday was in the employ of the respondent as a member of the crew of the Peter Kerr, in the capacity of a chef on a foreign voyage...
