Plaintiff's right knee joint was seriously injured when, while running backwards in the woods, (to avoid being hurt from a falling tree), he stepped with his right foot and leg into a stump hole. At the time of the accident he was primarily an employee of Earl Fredieu, independent contractor of the defendant, Mansfield Hardwood Lumber Company, who had engaged Fredieu to convert standing timber into logs, and to deliver them to the company's mill...
