Wyrick, a resident of Whitley County, Kentucky, died testate on March 18, 1948, and his widow, Sarah Sutton Wyrick, brought this action on June 18, 1949, in the Whitley Circuit Court against his heirs-at-law, who were his children by a former marriage, for a settlement of his estate.
