Respondents, as plaintiffs, brought this action against both the city of Seattle and King county to recover damages to real property caused by the invasion of surface waters. At the conclusion of the plaintiffs' evidence, the trial court, sitting without a jury, sustained a challenge to the sufficiency of the evidence interposed by the county and dismissed the case as to that defendant.
