This is an action for a declaratory judgment brought by appellee, Smith County, against the City of Tyler and two classes of citizens of said City, namely, those owning property fronting the courthouse square and those citizens owning the property within the 100 acres comprising the original town site. The suit concerns the title to the courthouse square within the City of Tyler and the rights, if any, of the two classes of citizens in the courthouse...
