STATE, EX REL. BREWER v. IND. COMM.

No. 32030.

153 Ohio St. 471 (1950)

THE STATE, EX REL. BREWER, APPELLANT, v. INDUSTRIAL COMMISSION OF OHIO, APPELLEE.

Supreme Court of Ohio.

Decided May 3, 1950.

Attorney(s) appearing for the Case

Mr. Maurice H. Shapiro and Mr. Edward Z. Stendel, for appellant.

Mr. Herbert S. Duffy, attorney general, and Mr. T. Vincent Martin, for appellee.

BY THE COURT. The commission found "that proof of record fails to show that the claimant has suffered three years of exposure to silica dust in his employment in the state of Ohio." This is the only question properly before us.

If this finding is supported by sufficient evidence, the judgment of the Court of Appeals should be affirmed. It is the claim of relator that there is no evidence to support such finding.
