This is an appeal by the City of Amarillo from a judgment entered in the court below on January 18, 1950, in which, after a trial of the issues presented, the court set aside and declared void and of no force or effect an order of the Civil Service Commission of the City of Amarillo demoting the appellee, Clark Hancock, from the rank of captain to that of driver in the Fire Department of the city.
