This is a condemnation proceeding. The jury awarded the respondents $5,000 as damages from which the state has appealed.

The situs of the controversy is on Highway 166, a short distance west of Sarcoxie and about one-fourth mile east of the junction of Highway 166 and Highway 38, leading to Monett.
