This case is before us both upon an appeal and a petition for writ of certiorari. The appellant-petitioner filed a bill of complaint in the Circuit Court of the Eleventh Judicial Circuit of Florida in and for Dade County on August 18, 1948. Her bill was denominated "A Bill for Declaratory Decree." Separate motions to dismiss the bill of complaint were filed by the appellees-respondents.
