Josiah F. Linthicum brought suit in the Circuit Court for Dorchester County upon the common counts and a special count for the care and maintenance of a dairy herd owned by Creston E. Jackson for the period from April 15, 1946 to January 25, 1947. The case was heard by the Court, without a jury, and resulted in a verdict and judgment for the appellee in the amount of $3128.33.
