LINCOLN, Justice.

This suit was for $5,000.00 alleged to be due the appellant as beneficiary under a policy of life insurance issued by appellee on the life of Herman E. McCann, her husband, dated August 21, 1945. The insured died on March 31, 1946. Upon a trial before the court on an agreed statement of facts judgment was rendered for appellant for $201.50. This was admittedly the amount of legal reserve accumulated as a result of premium payments made by the deceased...
