SWEPSTON, Judge.

In this cause the plaintiff seeks to hold defendants liable in tort for the loss of sweet potatoes stored in the defendant's warehouse, which, with its contents, was destroyed by fire on February 8, 1946.

On the first trial there was a peremptory instruction at the close of all the proof in favor of defendants on the ground of absence of material evidence tending to show negligence on the part of defendants.
