This is the second time this cause has been before this Court. Originally it was dismissed sua sponte by the trial judge as being a suit against the United States. The plaintiffs appealed. The Court of Appeals reversed and remanded the cause for trial on the merits. Dollar v. Land, 1946, 81 U. S.App.D.C. 28, 154 F.2d 307. Later this judgment was affirmed in the Supreme Court. Land v.
