This is an appeal in an action instituted by the Arkansas Fuel Oil Company, hereafter referred to as Arkansas, against Lacy D. Kirkmyer and others, a partnership trading as James River Oil Company, hereafter referred to as James River. The action sought recovery of $40,428.07 for oil and gasoline sold and delivered by Arkansas to James River between March 10 and November 2, 1943. Liability was admitted in the sum of $8,056.53 for petroleum products...
