This is a motion by the defendant to dismiss the complaint in the above entitled suit upon the ground that the court lacks jurisdiction over the subject matter.

The suit is brought under the Federal Tort Claims Act, Title IV, Legislative Reorganization Act of 1946, Public Law 601, 79th Congress, Second Session, approved August 2, 1946, 28 U.S.C.A. § 921 et seq. by Abraham Samson, as Administrator of his deceased son's estate....
