This appeal is from an order of the District Court, entered March 8, 1946, dismissing appellant's petition for a writ of habeas corpus. The court certified probable cause for an appeal. Appellant, John H. Rooney (referred to as petitioner), Henry P. Berry, and Rosalie Rizzo, were jointly tried and convicted of the crime of murder in the Superior Court of Cook County, Illinois.
