This is an appeal from an order of the District Court granting defendant's (appellee's) motion for summary judgment. The facts are not in dispute and, stated shortly, are as follows:

Appellant, a young man approximately twenty-eight years of age, and at the time an attorney at law in the active practice of his profession, took the competitive civil service examination for the position of Junior Legal Assistant in the Immigration and Naturalization...
