The indictment here charged that on or about October 8, 1941, defendant, Wolfgang T. Achtner, being an alien never naturalized as a citizen, "unlawfully, wilfully and knowingly did falsely represent himself to E. L. Kenney of the Ebasco Services, Inc., 2 Rector Street, New York City," to be a naturalized citizen of the United States, in violation of 8 U.S.C.A. § 746(a) (18), which was expressly cited.
