This is an appeal from a final order discharging a writ of habeas corpus, and remanding the petitioner to the custody of the jailer. Appellant (petitioner) was arrested and indicted for housebreaking in the latter part of 1941. On November 24th of that year he was arraigned and pleaded guilty.
