The few facts needed to understand the questions of law presented by this appeal may be stated briefly. The appellee, The National City Bank of New York, on November 4, 1940, filed a complaint in the District Court of the United States for Puerto Rico praying for the foreclosure of a mortgage which it held on a parcel of land situated in Puerto Rico.
