The appeal is from an order denying a petition for a writ of habeas corpus for want of jurisdiction in the court to issue it in the circumstances made by the case. Appellant is confined in the United States Penitentiary at Atlanta, Georgia, where he is serving a sentence of two to six years' imprisonment imposed May 15, 1935, upon his conviction in the court below of violating Section 865 of the District of Columbia Code.
