The suit was to recover the title and possession of 640 acres of land in Orange County, Texas. The claim of title was: A deed from defendant's parents, dated October 11, 1902, to Frank Mills, reciting $6,717, paid in cash and the reservation of a vendor's lien, to secure a note for $2,783; and a deed, dated October 24, 1902, from Mills to plaintiff Clara Hare, then Clara Brown.
