James Robert Sedam was indicted, tried, convicted, and sentenced for a violation of 18 U.S.C.A. § 400. He has appealed.

The facts are these: Sedam resides at Pocatello, Idaho, and Joy Mason resides at Idaho Falls, Idaho. In the latter part of October, 1939, Sedam met Miss Mason in Idaho Falls when he, another young man, and a young lady called at Miss Mason's home and asked her to go riding with them.
