This is an appeal from a judgment of the District Court entered April 27, 1939, awarding plaintiff a refund of $68,913.34 with interest, assessed and collected by reason of Section 603, Title IV of the Revenue Act of 1932, 26 U.S.C.A. Int. Rev. Acts, entitled "Tax on Toilet Preparations, etc." The section reads: "There is hereby imposed upon the following articles, sold by the manufacturer, producer, or importer, a tax equivalent to 10 per centum...
