The order appealed from is that of February 23, 1938, entered in a proceeding under Section 74 of the Bankruptcy Act, 11 U.S.C.A. § 202, in which appellee Harry Dubia had been appointed trustee. In such order, appellant's motion to withdraw his petition filed March 20, 1935, was denied and the court confirmed the referee's report entered December 20, 1935 denying the petition of appellant filed September 25, 1935, in which petitioner prayed...
