Plaintiff brought this action on a $5000 accident insurance policy. The court submitted the controverted issues to a jury which found for plaintiff. From a judgment entered on this verdict, defendant appealed.

Daniel J. Scanlan, a restaurant keeper, on September 19, 1929, took out an accident insurance policy with defendant which ran for a term of six months. It was renewed each successive six months and was in force on November 22, 1935...
