An involuntary petition in bankruptcy was filed against the appellant in the District Court for the Eastern District of New York on December 4, 1935. Two acts of bankruptcy were alleged. One of them is now immaterial, but the other was that the alleged bankrupt had, while insolvent, permitted Bessie Perlman, a creditor, to obtain a preference though legal proceedings not discharged or vacated within five days.
