Plaintiff, Boehne, sues the telephone company, and its employee, Powell, for damages growing out of personal injuries, which he claims to have sustained by reason of a collision between an automobile owned by the defendant telephone company, and driven by the defendant Powell, and an automobile in which plaintiff was riding.
