GARDNER, Circuit Judge.
This is a personal injury case, in which appellee, as plaintiff below, recovered judgment for $1,750 as damages for injuries inflicted on him when he was struck by defendant's truck as it was being backed out of a driveway at the side of the house in which appellee lived.
