Suit upon a bond in the penalty of $10,000 executed by J. Walter Jones as principal and by appellant as surety, guaranteeing the performance of a contract between Jones and appellee by which Jones was obligated to furnish the materials for, and to erect, a cold storage building on the land of appellee.
