Burtnett and Keatch were charged by indictment containing four counts with violations of section 3, title 2, of the National Prohibition Act (27 USCA § 12).

The first count charged possession on February 15, 1930, the second charged a sale on that date, and the third charged a sale on March 15, 1930, at Wichita, Kansas, of substandard fluid extract of ginger containing more than one-half of one percent of alcohol by volume, intended...
