In this case the facts are admitted and may be briefly stated. Samuel and William Quicksilver, brothers, were partners in a mercantile business. In 1927, a third brother, Nate Quicksilver, was admitted to a one-third interest in the partnership, for which he paid $5,000. This money he borrowed from a fourth brother, Edward Quicksilver.
