Mandler, hereinafter called plaintiff, brought this suit against Ingram, hereinafter called defendant, to establish and foreclose a pledge.

On December 1, 1926, plaintiff was the holder of a promissory note for $15,000 made by Robert Marshall and Miley Marshall, his wife, and secured by a first mortgage on 492 acres of land in Wagoner county, Oklahoma.
