When the relator falsely represented himself to be an American citizen at the time he entered in April, 1930, he was not examined as an alien. On the contrary, he evaded such an examination when he succeeded in getting passed as a citizen. Compare Saadi v. Carr (C. C. A.) 26 F.2d 458. Every alien who comes into the United States must enter as an alien whether he has been here...
