Appellant brought this action to recover damages by him sustained, arising out of an alleged breach of a contract which the parties had negotiated. In his complaint, appellant joined two causes of action; one for damages resulting from a breach of contract, and the other for damages arising out of appellee's alleged negligent and careless conduct, which negligent conduct prejudicially impaired appellant's rights under said contract.
